Two Weeks Notice Letter
A two weeks notice letter is a short written statement that you are resigning and when your last day will be. It exists to put the date on record, to protect the reference you will want later, and to start the handover. It does not need a reason, an apology or a paragraph about what you are doing next, and the best ones are under 150 words.

What the law requires
Nothing. Employment in every US state except Montana is at will, which means either side can end it at any time without notice. Two weeks is a professional convention, not a legal requirement, and no state penalises an employee for leaving without it. Three things can change that:
- An employment contract or offer letter with a notice clause. Common for executives, sales roles with commission plans and some professional positions. Breaking it rarely leads to a lawsuit, but it can affect what the contract pays out on departure, including bonuses, commissions and sometimes relocation or signing-bonus clawbacks.
- A handbook policy that ties notice to a benefit. Many employers pay out unused PTO, or keep an employee eligible for rehire, only if they give two weeks. That condition is enforceable in most states, with the exception that states which treat accrued vacation as earned wages require it to be paid regardless; the PTO payout guide lists them.
- Union agreements and public-sector rules, which usually set their own notice periods and procedures.
Your final paycheck is governed by state law, and the deadlines differ for quitting and for being fired. The final paycheck laws by state page has every state's rule; in California, for example, an employee who gives at least 72 hours' notice must be paid in full on the last day.
If your employer ends it early
Some employers accept a resignation and ask the employee to leave the same day, most often in sales, finance and any role with client relationships or system access. That is lawful under at-will employment, but it changes the character of the separation. If the employer ends the employment before the date you gave, you did not quit on that day; you were separated by the employer, and in many states that makes you eligible for unemployment benefits for the gap between the two dates, and sometimes beyond. Some employers pay out the notice period to avoid exactly that argument.
Ask, in writing, whether the employer is paying the notice period. If the answer is no, file for unemployment for the gap and let the state agency decide. Keep a copy of the notice letter with its date; it is the document that proves which day you chose.
How to hand it over
- Tell your manager in person, or on a call, first. The letter follows the conversation; it does not replace it. A manager who reads the resignation in an email before hearing it is a reference you have weakened.
- Send the letter the same day, by email with the letter attached or in the body, so there is a timestamped record. Copy HR if the handbook asks for it.
- Keep it short and positive. No reasons, no complaints, no feedback. The exit interview is where feedback belongs, and even there, measured.
- Offer a handover plan. The version in the generator with handover points is the one managers remember. Document the processes only you know, introduce your replacement or a colleague to the relationships, and return equipment on the schedule in the offboarding checklist.
